Uncertn - Privacy Policy

This website and the Uncertn mobile app are operated by Uncertn Inc., an Ontario Corporation ("Uncertn"). This Privacy Policy describes how Uncertn ("we", "us" or "our") collects, uses, discloses and protects your Personal Information when you visit uncertn.com (the "Site"), use the Uncertn mobile app (the "App"), join Uncertn Reserve, receive our messages or make a purchase from us. The Site, App, Uncertn Reserve and our messaging services are together referred to as the "Services".

In this Privacy Policy, "Personal Information" means any information about an identifiable individual.

Section 1 - Personal Information We Collect

We collect Personal Information directly from you, automatically when you use the Services, and from the service providers that help us run the Services. The list below explains what we collect, where it comes from, why we collect it, and who we disclose it to.

Account information

Purpose of collection: to create and manage your customer account, sign you in, show your order history and saved information, and provide customer support.
Source of collection: collected from you when you create an account or sign in, including through one-time sign-in codes sent to your email address.
Disclosure for a business purpose: shared with our e-commerce platform and hosting providers.
Personal Information collected: name, email address, phone number, saved addresses, customer account identifier and sign-in details.

Order information

Purpose of collection: to fulfill our contract with you, process payments, arrange shipping, provide invoices and order confirmations, handle returns and exchanges, communicate with you about your order, screen orders for potential risk or fraud, and, in line with your preferences, provide you with information about our products and offers.
Source of collection: collected from you at checkout and generated by our systems when your order is processed and shipped.
Disclosure for a business purpose: shared with our e-commerce platform, payment processors, shipping and fulfillment partners, returns and customer support providers.
Personal Information collected: name, billing address, shipping address, email address, phone number, products purchased, order totals, discounts used, order status and tracking details, and limited payment details such as payment method, card type, the last four digits of your card and payment status. See Section 2 for how card details are handled.

Device and Site usage information

Purpose of collection: to load the Site accurately for you, remember your preferences, keep the Site secure, measure and improve Site performance, and, where described in Section 5, show you relevant advertising.
Source of collection: collected automatically when you use the Site through cookies, log files, web beacons, tags and pixels.
Disclosure for a business purpose: shared with our e-commerce platform, analytics providers and, as described in Section 5, advertising partners.
Personal Information collected: browser type and version, IP address, time zone, cookie identifiers, pages and products viewed, search terms entered on the Site, referring links, and how you interact with the Site and our ads.

App information

Purpose of collection: to operate the App, deliver push notifications and Inbox messages you have chosen to receive, sync your saved wishlist lists across devices, send reminders about items left in your bag, show order confirmations and shipping updates, let you know when a new version is available, and understand how the App is used so we can improve it.
Source of collection: collected automatically from your device when you use the App, and from you when you change your settings.
Disclosure for a business purpose: shared with our hosting and database providers and with the push notification delivery services provided by your device's operating system.
Personal Information collected: an app-specific device identifier, push notification token, device platform and app version, notification preferences, Inbox messages and delivery records, App sessions and in-App activity (such as screens and products viewed, items added to your bag and notifications opened), bag activity used for reminders (such as the number of items, subtotal, the first item in your bag and the time of your last activity), and saved wishlist lists when you are signed in. When you are signed in, this information is linked to your customer account.

Uncertn Reserve information

Purpose of collection: to run Uncertn Reserve, including tracking points and tiers, issuing and redeeming rewards, processing points transfers, providing birthday benefits and survey rewards, and providing your membership pass for Apple Wallet.
Source of collection: collected from you, from your account and order history, and from your activity in Uncertn Reserve.
Disclosure for a business purpose: shared with our hosting and database providers and our email marketing provider. Points transfers show the recipient's first name and last initial to the sender.
Personal Information collected: name, email address, membership identifier, points balance and history, tier, rewards redeemed, points transfers (including the other member and any message you include), referrals, survey answers, birthday (month and day only), and the device information needed to keep your Apple Wallet pass updated.

Marketing and communications information

Purpose of collection: to send you the email, text message and push notification marketing you have agreed to receive, and to honour your communication choices.
Source of collection: collected from you when you sign up or change your preferences, and automatically when you interact with our messages.
Disclosure for a business purpose: shared with our email marketing and text messaging providers.
Personal Information collected: name, email address, mobile phone number, consent records, subscription status, and message interactions such as opens and clicks.

Reviews, surveys and other submissions

Purpose of collection: to display product reviews, improve our products and Services, and reward participation where offered.
Source of collection: collected from you when you submit a review, photo, survey answer or other content.
Disclosure for a business purpose: shared with our product review provider and hosting providers. Reviews you submit are displayed publicly with the name you choose to show.
Personal Information collected: name, email address, review content and photos, ratings, survey answers and order details needed to verify your purchase.

Customer support information

Purpose of collection: to provide customer support and resolve questions, complaints and requests.
Source of collection: collected from you.
Disclosure for a business purpose: shared with our customer support provider.
Personal Information collected: name, email address, phone number, billing and shipping address, order details, the last four digits of your payment card where needed to locate an order, and the content of your messages and chats with us.

Information stored only on your device
Some App features save information only on your device and do not send it to us: products you have recently viewed, your recent searches, your currency and market choice, wishlist lists you create while signed out, and a temporary record of a checkout in progress so the App can show your order confirmation. The App also keeps you signed in by storing your sign-in session on your device. This information is removed when you sign out, delete the App or clear its data.

Section 2 - Payment Information

Payment card details are entered only on our e-commerce platform's secure hosted checkout, whether you start checkout on the Site or in the App. In the App, checkout opens in a secure browser window provided by your device's operating system, separate from the App itself. Card details are processed by our e-commerce platform and its payment processors and do not pass through or get stored in the App or our own systems. We receive only limited payment details, such as the payment method, card type, the last four digits of your card and the payment status, to process orders, refunds and fraud checks.

Section 3 - Consent

How do you get my consent?
When you provide Personal Information to create an account, place an order, arrange a delivery, return a purchase or join Uncertn Reserve, you consent to us collecting and using it for the purposes described in this Privacy Policy, including the purposes that are reasonably necessary to provide that service to you.

We ask for your express consent before sending you marketing emails or text messages, unless the law allows us to rely on your existing relationship with us. Push notifications are only sent if you allow them on your device. Marketing consent is never a condition of purchase or of joining Uncertn Reserve.

How do I withdraw my consent?
You can withdraw your consent at any time, subject to legal or contractual restrictions, as described in Section 7. You can also contact us at legal@uncertn.com. Withdrawing consent may affect our ability to provide some Services, and we will explain this to you if it applies.

Section 4 - Sharing Personal Information

We do not sell your Personal Information for money. We share Personal Information only as described in this Privacy Policy:

Service providers. We use service providers to help us run our business and the Services, including our e-commerce platform, payment processors, shipping, fulfillment and returns partners, hosting, database and cloud providers, push notification delivery services, email marketing and text messaging providers, product review providers, customer support tools and analytics providers. They may use your Personal Information only to provide services to us and are required to protect it.
Advertising partners. On the Site, we share certain information with advertising partners as described in Section 5. The App does not share your information with advertising partners.
Other Uncertn Reserve members. When you transfer points, the recipient sees your name and any message you include. When someone sends you points, they see your first name and last initial.
Public content. Reviews and photos you choose to post are displayed publicly.
Legal and safety reasons. We may disclose Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request, to prevent fraud, or to protect our rights, our customers or others.
Business transfers. If Uncertn is involved in a merger, acquisition, financing or sale of assets, Personal Information may be disclosed to the parties involved, subject to appropriate confidentiality protections.

Section 5 - Behavioural Advertising and Site Tracking

On the Site, including our checkout pages, we and our advertising partners use cookies, pixels and similar technologies to measure our advertising and show you ads for our products that we believe may interest you. This includes sharing information about your use of the Site, your purchases and your interactions with our ads with those partners, who may combine it with information they hold about you.

The App does not use third-party advertising or tracking technologies and does not track you across apps or websites owned by other companies. The App's analytics are used only by us to operate and improve the App.

You can limit targeted advertising by adjusting the ad settings of the social media and search services you use, by managing cookies in your browser or through the Site's cookie settings where available, and by visiting the Digital Advertising Alliance's opt-out portal at https://optout.aboutads.info/ or, in Canada, the Digital Advertising Alliance of Canada's AdChoices page at https://youradchoices.ca/.

Section 6 - Using Personal Information

We use your Personal Information to:

offer products for sale, process payments, and ship and fulfill your orders;
create and manage your account and keep you signed in;
run Uncertn Reserve, including points, tiers, rewards, transfers, surveys and membership passes;
send order confirmations, shipping updates and other service messages;
send marketing emails, text messages and push notifications in line with your choices, including welcome offers, new products, restocks and reminders about items left in your bag;
provide customer support and handle returns, exchanges and complaints;
measure, maintain and improve the Site, App and our products;
measure and improve our advertising on the Site;
detect and prevent fraud, abuse and security incidents; and
comply with our legal obligations.

Automated decision-making:

We do not make decisions that have a legal or similarly significant effect on you based solely on automated processing. Our e-commerce platform uses limited automated tools to screen transactions for fraud, such as temporarily blocking IP addresses or cards associated with repeated failed transactions. If you believe a transaction was blocked in error, please contact us.

Section 7 - Marketing Communications and Your Choices

Email: use the unsubscribe link in any marketing email. We process unsubscribe requests within 10 business days.
Text messages: reply STOP to any message from us. Reply HELP for help.
Push notifications: turn them off in the App (Profile, then Notifications) or in your device settings.
Website advertising: see the choices described in Section 5.

Order confirmations, shipping updates, account sign-in codes and other service messages are not marketing and will still be sent when needed.

Section 8 - Where We Process Your Information

We are located in Canada. Our service providers store and process Personal Information in Canada, the United States, including data centres in the eastern United States, and other countries where they or their sub-processors operate. While your information is outside Canada, it is subject to the laws of those countries and may be accessible to their courts, law enforcement and national security authorities. We use contractual and other measures to require our service providers to protect your Personal Information.

Section 9 - Retention

We keep Personal Information only for as long as needed for the purposes described in this Privacy Policy or as required by law:

Account and order information is kept in our e-commerce platform for as long as your account remains open. Order and transaction records, including guest orders, are kept as part of our business records and to meet tax, accounting, fraud prevention and other legal obligations.
App information, including notification settings, Inbox messages, wishlist lists and App activity, is kept while you use the App and until you delete it or delete your account.
Uncertn Reserve information is kept while you are a member and until your account is deleted.
Marketing information is kept until you unsubscribe, after which we keep a record of your choice so we can respect it.
Information stored only on your device stays there until you sign out, delete the App or clear its data.

When information is no longer needed, we delete it or de-identify it. Copies in secure backups are deleted as those backups are routinely replaced.

Section 10 - Account Deletion

You can delete your account at any time in the App (Profile, then Delete Account) or at app.uncertn.com/delete-account. When you delete your account:

we delete your customer profile, or, where past orders exist, request erasure of your personal details from our e-commerce platform, which can take up to 30 days;
we delete or de-identify your App information, including saved wishlist lists, notification settings, Inbox messages and App activity linked to your account;
your Uncertn Reserve membership ends, your points are voided, and your Reserve information is deleted or de-identified;
you are unsubscribed from our marketing messages; and
we keep only the order and transaction records we are required or permitted to keep by law, such as for tax, accounting and fraud prevention, and a record of your deletion request.

Product reviews you have posted publicly may remain visible. You can ask us to remove them by contacting us.

Section 11 - Minors

The Services are not directed to children under the age of 13, and we do not knowingly collect Personal Information from them. Uncertn Reserve is only available to people who have reached the age of majority where they live. If you are a parent or guardian and believe your child has provided us with Personal Information, please contact us using the details in Section 17 and we will delete it.

Section 12 - Your Rights

Canada

You have the right to ask whether we hold Personal Information about you, to access it, to learn how it has been used and to whom it has been disclosed, to ask us to correct it if it is inaccurate or incomplete, and to withdraw your consent as described in Section 3. We respond to requests within 30 days, or within any longer period permitted by law, in which case we will let you know. We may need to verify your identity before responding.

Quebec

If you live in Quebec, you also have the rights provided by Quebec's private sector privacy law, including the right to receive certain Personal Information in a structured, commonly used technological format, and to be informed when a decision about you is based exclusively on automated processing.

European Economic Area and United Kingdom

If you live in the European Economic Area or the United Kingdom, we process your Personal Information on the basis of your consent, the performance of our contract with you, compliance with our legal obligations, and our legitimate interests in operating and improving our business, which do not override your rights. You have the right to access, correct, delete, restrict or object to the processing of your Personal Information, to data portability, and to withdraw consent at any time. You may also lodge a complaint with your local data protection authority.

United States

Depending on the state you live in, you may have rights to access, correct, delete or obtain a copy of your Personal Information, and to opt out of targeted advertising. You can make these requests by contacting us, and you may designate an authorized agent to make a request on your behalf. We will not discriminate against you for exercising your rights.

To make any request, contact us using the details in Section 17.

Section 13 - Security

We use reasonable administrative, technical and physical safeguards to protect your Personal Information from loss, theft and unauthorized access, use, disclosure, copying, modification or destruction. These include encrypted connections across the Site and App, access to customer information restricted to authorized personnel who need it for their work, and server-side checks that verify your identity before account and Uncertn Reserve information is accessed or changed. Payment card details are handled only by our e-commerce platform and its payment processors, as described in Section 2.

No method of transmission over the internet or electronic storage is completely secure. If a breach of security safeguards creates a real risk of significant harm to you, we will notify you and the Office of the Privacy Commissioner of Canada as required by law.

Section 14 - Cookies

A cookie is a small amount of information that is downloaded to your computer or device when you visit the Site. We use cookies and similar technologies on the Site that are necessary for the Site and checkout to work (such as keeping items in your cart and keeping you signed in), that remember your preferences (such as your region and currency), that help us understand how the Site is used, and that support advertising as described in Section 5. Where required, we ask for your consent before using cookies that are not necessary for the Site to work, and you can change your choices through the Site's cookie settings where available.

You can also control and manage cookies through your browser settings, often found in your browser's "Settings", "Tools" or "Preferences" menu. Please keep in mind that removing or blocking cookies can affect your experience, and parts of the Site, including checkout, may not work properly. For more information about managing cookies, visit www.allaboutcookies.org.

Blocking cookies may not completely prevent information from being shared with advertising partners. To limit targeted advertising, please follow the choices in Section 5.

Do Not Track
Because there is no consistent industry understanding of how to respond to "Do Not Track" signals, we do not change our data collection and use practices when we detect such a signal from your browser.

Section 15 - Changes

We may update this Privacy Policy from time to time to reflect changes to our practices or for other operational, legal or regulatory reasons. We will post the updated Privacy Policy on this page and update the "Last updated" date below. If we make material changes, we will notify you by email or in the App before they take effect.

Section 16 - Complaints

If you would like to make a complaint, please contact us by email or by mail using the details in Section 17. We will investigate and respond to your complaint.

If you are not satisfied with our response, you have the right to contact the Office of the Privacy Commissioner of Canada at https://www.priv.gc.ca. If you live in Quebec, you may also contact the Commission d'accès à l'information du Québec at https://www.cai.gouv.qc.ca. If you live outside Canada, you may also contact the data protection authority where you live.
